Official Contest Rules

1. DESCRIPTION: VOID WHERE PROHIBITED. The "Direct2Drive BioShock 2 First to the Finish" skill-based contest ("Contest") begins at 10:00 AM PST Tuesday, February 9, 2010 and ends when the first 50 qualified entries have been received ("Contest Period"). See Section 5 below for more details. The Sponsor of the Contest is IGN Entertainment, Inc. ("Sponsor").

2. ELIGIBILITY: Contest is open only to legal residents of the United States and Washington, D.C. (EXCLUDING residents of Louisiana, Tennessee, Vermont, Iowa, Arizona, North Dakota, and Florida) who (i) are at least 18 years old and have reached the legal age of majority at the time of entry; (ii) have purchased BioShock 2 through Direct2Drive; and (iii) own or have access to an Internet-enabled PC. Any individuals (including but not limited to employees, consultants, independent contractors and interns) who have, within the past six months, held employment with or performed services for Sponsor ("Contest Entities"), its parent companies, affiliates, subsidiaries, advertising and promotional agencies, prize suppliers or any organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Contest are not eligible to enter or win. Immediate family and household members of such individuals are also not eligible to enter or win. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. "Household Members" shall mean those people who share the same residence at least three months a year. Void where prohibited.

3. HOW TO ENTER: After purchasing the BioShock 2 game through Direct2Drive (www.direct2drive.com), download the game and play it through to the finish. When you have arrived at the final scene, take a screenshot and attach it in an e-mail addressed to D2DContests@gmail.com containing your full name and date of birth in the body of the e-mail. To ensure proper verification, please send the entry from the e-mail account registered with Direct2Drive. Entries will only be accepted during the Contest Period. Only one entry per person will be accepted. All entries become the property of IGN and will not be returned. IGN assumes no responsibility for lost, stolen, illegible, incomplete, incorrect, late or misdirected entries, or other errors or problems of any kind whether mechanical, human, or electronic. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. Use of a false email account will disqualify an entry. IGN at its sole discretion, reserves the right to disqualify any person who tampers with the entry process or the operation of the website, who violates the Contest Rules, or who otherwise interferes with the proper operation of the Contest. By entering, entrants accept and agree to abide by the terms of these official rules (these "Contest Rules").

4. PRIZES: The first 50 entries containing a screenshot of the final scene, as determined by Sponsor at its sole discretion, will receive a $20 store credit at Direct2Drive. Total Value of the Promotion = $1,000. In the event of a tie, the entrant achieving the highest overall Gamer Score, as determined by Sponsor in its sole discretion, will be considered the winning entry. Prize winners cannot assign or transfer the prize to another person. No cash or prize substitution is allowed except at the discretion of Sponsor. If a prize cannot be awarded due to circumstances beyond the control of Sponsor, Sponsor shall have no obligation to award a substitute prize. Any unclaimed prize may not be re-awarded, in Sponsor’s sole discretion. Other restrictions may apply. Odds of winning depend on the number of eligible entries received.

5. NOTIFICATION: Prize winners will be contacted on or about the week following the Contest Period. Selected winner will be required to respond (as directed) to the notification within 72 hours of attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize and, in such case, Sponsor will conduct another drawing to select an alternate winner. Prize winner may be required to verify address and to execute before a notary public and return within seven (7) days an affidavit of eligibility and liability/publicity release covering eligibility, liability, advertising, publicity and media appearance issues, unless prohibited by law. In certain circumstances, Prize may not be awarded until all such properly executed and notarized forms are returned (if applicable).

6. CONDITIONS OF PARTICIPATION/RELEASES: Contest is void where prohibited or restricted by law. All federal, state and local laws and regulations apply. By participating in the Contest, entrants agree to be bound by these official rules and the decisions of Sponsor, which shall be final in all respects. By participating in this Contest and/or by accepting any prize that they may win, entrants agree to release Sponsor; its direct and indirect parent companies, subsidiaries and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers; each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals’ respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Contest and/or acceptance or use of the prize. Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor's sole discretion, without further obligation or compensation. The Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, postage-due, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Contest; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Contest. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest, and reserve the right, in their sole discretion, to cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor's control, corrupt the administration, security or proper play of the Contest. Sponsor may prohibit you from participating in the Contest or winning a prize if, in its sole discretion, it determines you are attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair practices. This Contest will be governed by the laws of the state of California. Any and all legal actions of claims arising in connection with this Contest must be brought in a court of competent jurisdiction with California and you hereby submit to jurisdiction in California. All taxes, fees, and surcharges on prizes are the sole responsibility of the prize winner. Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

7. PRIVACY POLICY: Any personal information supplied by you to Sponsor will be subject to Sponsor's privacy policy posted at http://corp.ign.com/privacy.html. Acceptance of a prize constitutes permission for Sponsor, and its advertising and promotional agencies to use winners' names and likenesses for advertising and promotional purposes without additional compensation unless prohibited by law.

EXCLUDING ONLY APPLICABLE MANUFACTURERS’ WARRANTIES, THE PRIZES ARE PROVIDED TO WINNERS "AS IS" WITHOUT FURTHER WARRANTY OF ANY KIND. SPONSOR DISCLAIMS ALL FURTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE PRIZES.

IN NO EVENT SHALL SPONSOR BE RESPONSIBLE HEREUNDER FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES INCURRED BY ANY ENTRANT OR ANY THIRD PARTY EVEN IF SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
